Dallas, TX (PRWEB) June 17, 2005 -- Hermes Sargent Bates attorney Chuck Shiver successfully represented Southernbelle, L.L.C., and their tractor-trailer driver Wesley Parm, in a personal injury lawsuit. On June 6, after a two-day trial, the Dallas Country jury returned a unanimous verdict in favor of the defendants.
The case was presented in Judge Russell Rodens court. The Plaintiff, who was involved in a collision with a tractor-trailer and several other vehicles, claimed an unsafe lane change caused the collision. Plaintiff sought in excess of $300,000 in damages, including past medical expenses, future wages, and pain, suffering and mental anguish.
At trial, the Defendants demonstrated that the accident sequence began after debris was thrown into the roadway from a disabled vehicle. They argued that the ensuing multi-vehicle accident resulted from a sudden emergency and/or was an unavoidable accident.
After a two-day trial, and only 30 minutes of deliberations, the jury returned a unanimous verdict finding no negligence on the Defendants, and that the Plaintiffs were not entitled to any damages
Were pleased with the results, says Mr. Shiver. Our thorough preparation allowed us to concisely show the jury that the fault was not our clients. A short trial means less time away from work for our client and their driver."
